Rubbish Clearance Islington Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Islington provides rubbish clearance and related waste collection services. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste removal service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Company means Rubbish Clearance Islington, the provider of rubbish clearance and waste collection services.

1.2 Customer means the person, firm or company who requests and pays for the services of the Company.

1.3 Services means any rubbish clearance, waste collection, loading, transportation, disposal, recycling or related services provided by the Company.

1.4 Site means the property, premises or location at which the Services are to be performed.

1.5 Waste means any rubbish, junk, household waste, commercial waste or other materials agreed to be removed by the Company, excluding prohibited or hazardous items as set out in these Terms and Conditions or under applicable law.

2. Scope of Services

2.1 The Company provides waste collection and rubbish clearance services for domestic and commercial customers, including but not limited to the collection, loading and removal of unwanted items, bagged waste, bulky items, garden waste and light construction debris, subject to legal and safety requirements.

2.2 The exact scope of the Services for each booking, including the estimated volume or weight of Waste, type of Waste to be collected, access arrangements and any special requirements, will be agreed with the Customer at the time of booking.

2.3 The Company reserves the right to refuse to remove any Waste that is hazardous, dangerous, prohibited by law, incorrectly described, or which the Company reasonably believes may pose a risk to its staff, vehicles or third parties.

3. Booking Process

3.1 Bookings for rubbish clearance and related Services may be made by telephone, email or any booking system offered by the Company.

3.2 The Customer must provide accurate and complete information at the time of booking, including:

a. The full address of the Site and any access restrictions.

b. A clear description of the type and approximate quantity or volume of Waste to be collected.

d. Preferred dates and times for collection.

3.3 Any price or quotation provided before arrival at the Site is based on the information supplied by the Customer. The final charge may be adjusted on arrival if the quantity, type or location of Waste differs materially from that described at the time of booking.

3.4 A booking is only confirmed when the Company has accepted the Customer’s request and provided a confirmation by verbal agreement, email, text message or other written form.

4. Access and Site Conditions

4.1 The Customer is responsible for providing safe, adequate and lawful access to the Site for the Company’s staff and vehicles.

4.2 The Customer must ensure that:

a. The Waste is accessible and ready for collection at the agreed time.

b. Any gates, parking restrictions, entry systems or security arrangements are managed so that the Company can carry out the Services without delay.

c. The Site is reasonably safe, free from excessive hazards and suitable for the Services to be performed.

4.3 If the Company is unable to perform the Services due to inadequate access, unsafe conditions, or incorrect information provided by the Customer, the Company may charge a call-out fee and any reasonable costs incurred.

5. Pricing and Quotations

5.1 Prices are generally based on the volume and type of Waste, the labour required, and any additional services requested, such as dismantling, heavy lifting or multiple trips.

5.2 Any quotation given before inspection of the Waste is an estimate only. The final price will be confirmed on Site once the Waste has been assessed. The Customer will be informed of any change in price before work begins and may choose whether to proceed.

5.3 Prices include standard loading time. If additional time is required due to factors outside the Company’s control, additional charges may apply based on the Company’s current rates.

5.4 Prices may be subject to applicable taxes and charges as required by law. Any such amounts will be notified to the Customer.

6. Payments

6.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing before the booking is confirmed.

6.2 The Company accepts payment by cash, card, bank transfer or other methods expressly offered by the Company. Certain payment methods may be subject to minimum amounts or additional verification.

6.3 For commercial or account Customers, payment terms will be agreed separately. Invoices must be paid by the due date stated. The Company reserves the right to charge interest on late payments at the maximum rate permitted by law, together with any reasonable costs incurred in recovering overdue amounts.

6.4 If the Customer fails to make payment in full when due, the Company may suspend or cancel any further Services, and may take such steps as are necessary to recover any outstanding sums.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company directly.

7.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation charge will usually apply, unless specific costs have been incurred in preparation for the booking, in which case the Customer will be informed.

7.3 If the Customer cancels within 24 hours of the scheduled collection time, the Company may charge a reasonable cancellation fee to cover the costs of allocated labour, vehicle time and administration.

7.4 If the Company arrives at the Site at the agreed time and is unable to carry out the Services due to the Customer’s act or omission, including but not limited to lack of access, absence of an authorised representative, or refusal to proceed, the Company may treat the booking as cancelled and charge a call-out or cancellation fee.

7.5 The Company reserves the right to cancel or reschedule a booking where necessary due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, safety concerns or legal restrictions. In such cases, the Company will offer an alternative collection time. The Company will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

8. Customer Responsibilities

8.1 The Customer is responsible for ensuring that all Waste presented for collection is accurately described, suitable for transport, and not in breach of any law or regulation.

8.2 The Customer must not present for collection any prohibited or hazardous items, including but not limited to:

a. Asbestos or asbestos-containing materials.

b. Clinical or medical waste, syringes or pharmaceuticals.

c. Corrosive, explosive, flammable or toxic substances.

d. Gas bottles, pressurised containers or fuel tanks not properly purged.

e. Chemicals, solvents, paints, oils or similar substances, unless expressly agreed in writing.

8.3 If prohibited or hazardous Waste is discovered among the Waste to be collected, the Company may refuse to remove it, may adjust the price to reflect special handling requirements, or may terminate the Services. The Customer will be responsible for any additional costs, fines or liabilities arising from misdescribed or unlawful Waste.

9. Performance of the Services

9.1 The Company will use reasonable skill and care in performing the Services and will aim to carry out collections at the agreed time or within a reasonable window. However, all times are approximate, and delays may occur.

9.2 The Company’s staff will load the Waste onto the Company’s vehicle, subject to safe manual handling and access. The Company may decline to move items that are excessively heavy, dangerous, fixed to the property, or otherwise unsuitable for removal.

9.3 The Customer or an authorised representative should be present at the Site during the collection to confirm the Waste to be removed and to approve any changes in pricing or scope. If no representative is present, the Company’s assessment will be final and binding for the purpose of pricing and completion of the Services.

10. Waste Transfer and Environmental Compliance

10.1 The Company is committed to lawful and responsible waste management and will dispose of or recycle Waste in accordance with applicable UK waste regulations and duty of care requirements.

10.2 The Company or its authorised partners will transport Waste only to appropriately licensed or permitted facilities.

10.3 Where required, a waste transfer note or similar documentation will be completed and retained in line with legal obligations.

10.4 Title to the Waste will pass from the Customer to the Company once the Waste has been loaded onto the Company’s vehicle, provided that full payment is made in accordance with these Terms and Conditions.

11. Liability and Limitations

11.1 The Company will take reasonable care when carrying out the Services to avoid damage to the Customer’s property. However, the Customer is responsible for protecting items or surfaces that may be vulnerable during the rubbish clearance process, such as carpets, flooring, walls, door frames, and garden surfaces.

11.2 The Company will not be liable for:

a. Any pre-existing damage or defects to the property, fixtures, fittings or items.

b. Damage arising from the movement of items where the Customer has requested or insisted upon removal against advice.

c. Indirect, special or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of enjoyment.

11.3 The total liability of the Company to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Services giving rise to the claim, except where such limitation is prohibited by law.

11.4 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

12. Complaints

12.1 If the Customer has any concerns or complaints about the Services, they should contact the Company as soon as reasonably possible, providing full details of the issue.

12.2 The Company will investigate any complaint in good faith and will seek to resolve the matter promptly, which may include reviewing Site photographs, waste transfer records, staff reports or other relevant evidence.

12.3 Where appropriate, the Company may offer a remedy such as a partial refund, a repeat visit or other reasonable solution. Any remedy is at the Company’s discretion, subject to the Customer’s statutory rights.

13. Data Protection and Privacy

13.1 The Company will collect and process personal data provided by the Customer only for the purposes of managing bookings, performing the Services, processing payments and administering its business.

13.2 The Company will handle personal data in accordance with applicable data protection laws and will take reasonable steps to keep such data secure and confidential.

13.3 The Customer has the right to request access to personal data held by the Company and to request correction of any inaccuracies, subject to legal conditions.

14. Force Majeure

14.1 The Company shall not be liable for any delay or failure in performing its obligations under these Terms and Conditions where such delay or failure is due to events beyond its reasonable control, including but not limited to extreme weather, natural disasters, strikes, industrial disputes, accidents, road closures, acts of government, pandemics or other similar events.

15. Changes to Terms and Conditions

15.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the updated Terms and Conditions are published or otherwise communicated.

15.2 It is the Customer’s responsibility to review the current Terms and Conditions prior to making a booking. By confirming a booking, the Customer agrees to the Terms and Conditions in effect at that time.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or any related matters.
